Jammu: Jammu and Kashmir comes under the President Rule today, Dec 19. President rule comes into effect after the completion of six months of the Governor’s rule. Now all the legislative powers of the State Assembly rest with the Parliament .

J&K has separate constitution under which the Governor’s rule is imposed once the Assembly is dissolved. It remain in effect for six-month. During Governor’s rule all legislative powers rest with the Governor.

It’s for this reason that on the dissolution of Assembly, the Governor had said that thanks to the separate constitution of State , he didn’t have to seek permission of the Delhi to dissolve the Assembly.

Governor’s rule was imposed on June 20 after BJP withdrew support  to PDP.  NN Vohra was  then Govenor  who was  replaced by Satya Pal Malik on Aug 23.

The Legislative Assembly was dissolved on November 21

As per SC directions, assembly elections to be conducted within six months of dissolution of the House.

If elections are not held, President Rule can be extended by another six months

Presidential proclamation can’t remain in force for more than three years except on intervention of Election Commission of India

Longest spell of  President’s rule in J&K of about 6 years was from 1989 to 1996 when the  then  Chief Minister Dr Farooq Abdullah had resigned in 1989 after appointment of Jagmohan as new Governor

President’s rule  ended in October 1996  after Farooq Abdullah was again elected as the Chief Minister.
